Nothing on this website is intended as professional, dietary or medical advice.

Products, flavors, sizes, designs, decorations and availability may change at any time. Some items are seasonal or available only in limited quantities.

Everything we make is handcrafted, so reasonable variations in appearance, color, decoration and presentation may occur. Photographs on this website are representative of our work; a handcrafted product may not be identical to a photograph.

Prices are subject to change. The applicable price for an order is the price displayed or confirmed at the time the order is placed, subject to correction of obvious errors where legally permitted.

Taxes, delivery charges, service charges or other applicable fees may be added where appropriate.

All orders are subject to availability and acceptance. Receiving an order request, message or inquiry does not by itself mean the order has been accepted — an order is accepted once the applicable ordering or confirmation process has been completed.

Preparation times vary depending on the product, the level of customization and current availability.

Cake by CM offers selected cakes that may be prepared quickly or on the same day, depending on availability. We do not guarantee that any particular cake will be available or ready within a specific timeframe.

Any preparation or readiness times shown on this website or communicated to you are estimates. They can vary based on order volume, product selection, customization and operational circumstances.

Custom cakes and special-order products may require additional preparation time and advance scheduling.

Colors, decorative elements and handcrafted designs naturally vary. Inspiration or reference photographs you share with us are used as creative references only and should not be interpreted as a guarantee of an exact replica.

Important allergen notice: our products are prepared in a shared kitchen where common allergens are present.

These may include, as applicable:

• Milk and dairy
• Eggs
• Wheat and other gluten-containing grains
• Soy
• Peanuts
• Tree nuts

Because equipment, surfaces and utensils are shared, cross-contact with allergens is possible even when an ingredient is not listed in a specific recipe. We cannot guarantee that any product is free from a particular allergen.

If you or your guests have allergies, sensitivities or dietary restrictions, please contact us before ordering at 786-786-4061 or cake@cakebycm.com so we can discuss what is and is not possible. We do not describe any product as allergen-free unless we specifically confirm it for your order.

Customers are responsible for selecting and confirming the appropriate pickup date and time, and for collecting the order at the agreed time.

Cakes and desserts are delicate and perishable. Once an order has been picked up, the customer is responsible for appropriate transportation, handling, refrigeration and storage.

Where delivery is available, delivery windows are estimates rather than guarantees unless specifically agreed otherwise in writing. Availability, distance, fees and timing vary.

We may use third-party delivery providers. Once an order has been handed to a delivery provider or recipient, handling and storage are outside our control.

Our logo, branding, website design, original photographs, graphics, written content and original cake designs — where legally protectable — may be protected intellectual property. They may not be copied, reproduced or used commercially without our written authorization.

This website links to and may embed third-party services, including our online ordering and payment provider, delivery providers, Google Maps, Instagram and WhatsApp. Those platforms operate independently and have their own terms of service and privacy practices, which apply when you use them.

We do not guarantee uninterrupted or error-free availability of this website, and we may update, modify or temporarily discontinue parts of it without notice.

To the fullest extent permitted by applicable law, Cake by CM is not liable for indirect, incidental, special or consequential damages arising from the use of this website or from the use, handling or storage of our products after they leave our care.

Nothing in these Terms limits or excludes any liability or consumer right that cannot legally be limited or excluded, including liability for fraud, willful misconduct or matters governed by mandatory food-safety and consumer-protection law.

These Terms are governed by the laws of the State of Florida and applicable United States federal law, without limiting any mandatory consumer rights or other laws that apply to you.

We may update these Terms from time to time. The current version and its updated date will always appear on this page, and continued use of the website after an update means you accept the revised Terms.
